This Driver Agreement sets out the terms under which you provide transportation services using the Elite Rides Driver platform.
1. Parties and Purpose
This Driver Agreement ("Agreement") is a DRAFT for attorney review between you ("Driver," "you") and Elite Rides. It governs your use of the Elite Rides Driver app and related tools to receive trip requests and provide lawful transportation services to passengers who request rides through Elite Rides. This Agreement works together with the Terms of Use, Privacy Policy, Community Guidelines, Safety Policy, and other Elite Rides policies. If there is a conflict on a driver-operations topic, this Agreement controls after counsel finalizes the hierarchy.
2. Independent Contractor Status
You acknowledge that you are an independent contractor. Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship. You: • Decide whether, when, and where to go online (subject to eligibility, geofencing, and safety rules) • Provide your own vehicle meeting Elite Rides requirements • Are responsible for all taxes, licenses, and permits required for your activity • Are not entitled to employee benefits from Elite Rides Elite Rides provides a technology platform that connects drivers and passengers; Elite Rides is not a transportation carrier unless required by local law (counsel to confirm per market).
3. Onboarding and Eligibility
Before going online you must: • Create an account with email/password (Firebase Auth) • Submit required documents (license, insurance, registration, and other items we specify) • Complete identity verification, including a selfie reviewed by human reviewers; when face-matching providers are configured, photos may be processed for identity matching • Maintain an approved eligibility status and not be suspended We may re-check documents, identity, or vehicle information at any time.
4. Vehicle, Device, and App Requirements
You must: • Use a vehicle that meets Elite Rides standards for the applicable service tier • Maintain required insurance and keep documents current in the app • Use a compatible smartphone with the official Elite Rides Driver app • Grant necessary permissions (location, camera for verification/documents, notifications) • Not use unofficial, modified, or emulated clients that bypass App Check or security controls
5. Performance Standards
While using the Services you agree to: • Comply with all traffic and transportation laws • Provide safe, professional service consistent with Community Guidelines and Safety Policy • Navigate using the app's maps/location features responsibly • Keep accurate online/offline status; do not spoof GPS or manipulate trip states • Treat passengers with respect; no discrimination, harassment, or refusal based on protected characteristics except as allowed by law (for example safety-based refusals)
6. Fares, Tips, and Payouts
Fares and tips are determined according to Elite Rides pricing and trip rules then in effect. Earnings summaries appear in the app. When Stripe Connect is enabled, you may be required to complete Stripe Connect onboarding to receive payouts. Stripe processes payout-related payment data under Stripe's terms. Until Connect is enabled for your market/build, payout functionality may be unavailable. Elite Rides may adjust earnings for errors, cancellations, tolls, refunds, chargebacks, fraud, or policy violations. You are responsible for reporting and paying your taxes.
7. Data and Privacy
You consent to collection and use of your information as described in the Privacy Policy, including location while online/on-trip, documents, identity verification photos, FCM tokens, Crashlytics diagnostics, and App Check signals. You must not misuse passenger information obtained through trips.
8. Insurance and Liability
You must maintain all insurance required by law and by Elite Rides policies. Platform-contingent coverage, if any, will be described in market-specific notices when available. You are responsible for damage, injury, or loss arising from your operation of the vehicle to the fullest extent permitted by law. Indemnity terms in the Terms of Use apply.
9. Suspension and Termination
Either party may stop using or providing access to the platform subject to these policies. Elite Rides may suspend or deactivate your account for safety, fraud, quality, legal, or policy reasons. See Deactivation Policy and Appeal Policy.
10. Modifications
We may update this Agreement by publishing a new version with an updated effective date. Continued use after the effective date constitutes acceptance to the extent permitted by law.
